Live Chat with Q&A: An explanation of capacity issues for ESSA members

This presentation will consider what capacity is, the test for establishing capacity in various contexts, the “red flags” to be aware of and how best to manage these red flags in daily practice.  Consideration will also be given to who is the appropriate person to make decisions when the requisite capacity cannot be established.

Arabella is a Senior Associate at Maurice Blackburn Lawyers and leads the National Estate Administration team.  Arabella completed her Bachelor of Laws at James Cook University and holds a Masters of Applied Law majoring in Wills and Estates. She is a member of the Society of Trust and Estate Practitioners, a global community of lawyers specialising in the area of succession law.
Arabella has practiced almost exclusively in the area of succession law since her admission and regularly advises clients in estate litigation and complex estate administration matters
